A home owner in foreclosure may be working on a short sale, loan mod and other options simultaneously to delay their foreclosure sale date. An REO property belongs to the bank and is available for purchase the day it is listed. Many vacant REOs are subject to code enforcement citations by the local municipality creating an even larger potential liability for the bank that owns the property. Many investors make the mistake of guesstimating market rents when trying to determine monthly cashflow on an REO purchase. Fannie Mae does not warrant or guarantee any work that may have been done on an REO property, whether as part of its efforts to sell the home or pursuant to conditions in the purchase contract If an REO buyer has a Federal Tax Lien that is in a repayment agreement, you do not have to pay it off in full but you must be able to qualify with the monthly payment of the repayment agreement. State Tax Liens typically must be paid in full prior to closing your FHA loan on an REO. The bank may ask for you to submit a loan application so it can prequalify you for an REO, however, you are not obligated to obtain your loan from that bank. The margin can be low in REO's, but the risks are also low. And they take less of your time, if you just keep your ear to the ground for the right combination of events to converge. Many investors shy away from REO properties or HUD homes because they feel they have less negotiating power or simply lack the capital to make aggressive offers and play along with the rules that REO lenders stipulate. In their efforts to create a bidding frenzy, many REO agents will claim that they have 10, 15, 20 or more offers on a REO house when in reality their are only a few offers that the banks would consider. Don't be discouraged by this kind of talk and submit your educated offer. While you may get outbid on a new piece of REO inventory by a first timer, it can be beneficial to evaluate and track the house. If and when it falls out of escrow, you will be poised to make a quick offer and the bank will be in more of a wholesale mood as time goes along. REO: this is an acronym for Real Estate Owned, and this used to be called the bank department that managed the properties the bank had reacquired through a foreclosure process A common misconception is that foreclosures and REOs are the same. Although they are similar they are in fact different with the REO being the direct result of a foreclosure option sale. An REO is a property that has been foreclosed on and has reverted back to the ownership of the bank or lender.
